We are delighted to invite you to the first in our series of Arcadis Contract Solutions’ Events
for 2017. This seminar will be looking at the latest developments in payment and payless notices
within construction contracts.
The Local Democracy, Economic Development and Construction Act 2009
was intended to simplify payment processes within the construction industry. It was there to simplify matters. If ever a piece of legislation has led to unintended consequences this is one such example. The wrong notice; the wrong timing of the notice; the wrong words in the notice can all lead to draconian consequences.
Gary Kitt of Arcadis
will be the Chairman for the evening's discussion and will be providing a background to the topic our two guest speakers will be presenting.
- Alexander Nissen QC of Keating Chambers will examine the recent trends coming out of the Technology and Construction Court relating to payment and payless notices.
- Andrew Rush of Birketts LLP will highlight what is now understood to amount to an effective payment and payless notice as well as highlighting the do’s and don'ts where such notices are concerned. He will also highlight common pitfalls for the unwary.
The aim is that by the end of the seminar you will be confident in understanding the basics of payment and payless notices, the pitfalls of getting it wrong and the Court's approach to enforcing payment and payless notice adjudications.
We anticipate this seminar will be of interest to all those in the construction industry who may become involved in the payment process and who want to be up to speed with the latest developments including employers, contractors and professional consultants.
